Terms of Use

1. Introduction
These Terms of Use ("Terms") govern your use of the Devaura website at devaura.co.in ("Platform") and all services provided through it. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
Devaura is operated as a proprietorship from Ghaziabad, Uttar Pradesh, India.
2. Nature of Service
Devaura is a managed marketplace. We connect yajamana families ("Customers") with independently practising Hindu pandits ("Service Providers") for religious ceremonies. Devaura is not a religious organisation, temple, or trust. We facilitate the booking and do not perform the rituals ourselves.
Pandits on our platform are independent contractors, not employees of Devaura. The contract for the religious ceremony is between the Customer and the Pandit. Devaura acts as an intermediary within the meaning of Section 2(1)(w) of the Information Technology Act, 2000 (Act No. 21 of 2000), read with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
3. Eligibility
You must be at least 18 years of age and competent to contract within the meaning of Section 11 of the Indian Contract Act, 1872 (Act No. 9 of 1872) to use this Platform. By creating an account, you represent that you meet these requirements.
4. Account Registration
You are responsible for maintaining the confidentiality of your login credentials. All activities under your account are your responsibility. If you suspect unauthorised access, notify us immediately at care@devaura.co.in.
5. Booking and Payment
Pricing: All prices displayed on the Platform are inclusive of applicable GST (currently 18% on services, per Chapter V of the Central Goods and Services Tax Act, 2017, Act No. 12 of 2017). Surge charges (weekend +10%, festival +20%) are applied to the service charge only and are clearly displayed before booking.
Payment modes: Pay After Pooja (UPI / Card / Cash at ceremony) or Pay Now (with 5% loyalty credit). Devaura does not store your payment card details.
Confirmation: A booking is confirmed only when you receive a confirmation email and booking ID. Pandit allocation occurs within 6 hours of confirmation.

7. Shop Orders
Products sold through the Devaura Shop are physical goods (pooja essentials). Delivery is available within NCR only. Returns are accepted within 7 days of delivery for unused, sealed products. Perishable items (fresh flowers, panchamrit kits) are non-returnable.
8. Intellectual Property
All content on this Platform — including text, design, logos, graphics, and software — is the intellectual property of Devaura and is protected under the Copyright Act, 1957 (Act No. 14 of 1957) and the Trade Marks Act, 1999 (Act No. 47 of 1999). You may not reproduce, distribute, or create derivative works from our content without prior written consent.
9. Limitation of Liability
Devaura provides the Platform on an "as is" basis. To the maximum extent permitted under applicable Indian law, Devaura shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or services booked through it. Our total liability for any claim shall not exceed the amount you paid for the specific booking or order giving rise to the claim.
10. Dispute Resolution
Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through mediation. If mediation fails, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1996 (Act No. 26 of 1996), with a sole arbitrator mutually agreed upon. The seat of arbitration shall be Ghaziabad, Uttar Pradesh.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Subject to the arbitration clause above, the courts at Ghaziabad, Uttar Pradesh shall have exclusive jurisdiction.
12. Consumer Grievance
If you have a grievance regarding any service or product, write to our Grievance Officer at care@devaura.co.in. We will acknowledge your grievance within 48 hours and resolve it within 30 days, in compliance with the Consumer Protection Act, 2019 (Act No. 35 of 2019) and the Consumer Protection (E-Commerce) Rules, 2020.
13. Amendments
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Platform after changes constitutes acceptance.
